Terms of Service

These Terms of Service ("Terms") govern your use of Backy (the "App"), provided by ORPTECH Software. By installing or using the App, you agree to these Terms.

1. The service

Backy provides back-in-stock waitlists, pre-order capture, and notification delivery for Shopify stores. Paid plans let merchants connect their own email provider (BYO-ESP) to send unlimited notifications from their own domain.

2. Merchant responsibilities

• You are responsible for the accuracy of credentials you connect (including third-party email provider keys) and for complying with that provider's terms.
• You are responsible for obtaining any consent required to email your shoppers and for the content of notifications sent on your behalf.
• You must comply with applicable laws, Shopify's terms, and anti-spam regulations.

3. Acceptable use

You may not use the App to send unsolicited bulk email, unlawful content, or to abuse the App's infrastructure. We may suspend access for violations.

4. Billing

Paid plans are billed through Shopify's billing system and appear in your Shopify charges. You can change or cancel your plan at any time from within Shopify.

5. Availability & disclaimer

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted delivery of notifications; delivery depends on third-party providers and Shopify webhooks. To the maximum extent permitted by law, ORPTECH Software is not liable for indirect or consequential damages arising from use of the App.

6. Intellectual property

The App is proprietary software owned by ORPTECH Software. All rights reserved. No part of the App may be copied, distributed, or reverse-engineered without written permission.

7. Termination

You may stop using the App at any time by uninstalling it from your Shopify admin. Upon uninstall, data is removed in accordance with our Privacy Policy.
